To built a house

It is known that the problem started accruing since the middle of the 1990s when for last time land sites for individual housing were distributed by authorities, and then all the auls appeared to be "clamped" by agricultural lands or the lands of the national park (state forest land fund), being in the federal property.
In a reply to addresses from the VI congress of the Black sea Adygs-Shapsugs, taken place on April, 30th, 2007, and Khasa (public parliament) the Black sea Adygs-Shapsugs the administration and Legislative assembly of Krasnodar regional took some measures on designation of that problem at the federal level and preparation of legislative initiatives, consideration and adoption of which demanded, certainly, a lot of time. From the very beginning the position of the regional authorities had been aimed on the cardinal resolution of the question calculated on prospect. They decided to work out separate general plans for development of auls of Lazarevsky and Tuapsinsky areas, for that purpose from budgets of various levels including the regional one, in 2010-2011 they allocated over 15 million roubles.
For today development of general plans which in the near future should be submitted for statement to the Government of Russian Federation, is completely finished. The project provides global changes - remittance of all the agricultural lands, situated around the auls, into borders of those settlements, i.e. - into municipal property.
Unfortunately, in development of the general plan settlement Shkhafit, next time "suffered" from all of the same notorious town line, was not included. Adyghe Khasa sent a letter to the address of the mayor of Sochi А.N. Pahomov with a request to consider during updating borders of settlements the long-term request of inhabitants of settlements Shkhafit and Tihonovka about removal of borders of those settlements out of the limits of town line according to the decision of the Town Assembly of Sochi # 89 from July, 14th, 2009. But that event should be preceded with uneasy procedure of formation of settlements Shkhafit and Tihonovka as independent settlements according to the Law of Krasnodar region “About administrative-territorial structure of Krasnodar region and order of its change”.
Ending of development of the general plans for development of the auls, certainly, is an important stage on the way to resolution of the sharpest social problem. However ahead there is still a lot of the complex and not clear procedures interfaced to a set of some legal collisions. While it is possible to speak only about some basic approaches which can be preliminary the following.
Land sites will be generated in 0,12 hectares each one for a personal part-time farming with the right of construction of an apartment house.
Granting such sites should occur only after the official consent of the councils of homeowners’ communities (Chilae Khasa) of the auls, without any tenders which, in case of their application, instead of preservation of the ethnic originality could lead to the opposite consequences - loss of the primordial inhabitancy and acceleration of the rates of assimilation of Shapsugs.
The form of using such land site can be a long-term rent with the right of giving the right of succession, but without the right of privatization or sale, which is also dictated by necessity of Shapsugs’ protection from their assimilation guaranteed to the indigenous small peoples by the Constitution of Russian Federation and the federal legislation.
The effective utilization of the land site can be only in its special-purpose designation.
In a case of cancellation of a rent contract under a tenant’s initiative, only estimated cost of the construction and plantings should be compensated to the last one. The land site should be returned to the local community for its subsequent redistribution.
Only implementation of these principles, possible even within the limits of the current legislation (and corresponding statutory acts of the government bodies in a case of need - confirmed by its adoption), is capable to turn all this work for the good of preservation of the primordial inhabitancy and the ethnic originality of Shapsugs.
The personal position of the head of the regional administration (governor) of Krasnodar region A.N.Tkachev and the chairman of the Legislative assembly of Krasnodar region V.A.Beketov allowed shifting the question from its dead point, gives some confidence that the major for Shapsugs social project as a result of which hundreds young families in auls will have an opportunity to construct their houses, will be implemented.
