TURKISH CITIZEN'S LAWYER TO TAKE LEGAL ACTION AGAINST FSB AGENTS
KABARDINO-BALKARIYA, August 25, Caucasus Times - On August 25, speaking at a press conference called by rights activist Valeriy Khatazhukov and the lawyer Iskhak Kuchukov for journalists, the latter said he intended to call FSB agents to accounts for abuses and arbitrariness as they illegally exiled his client Bolat Haji Bairam from the republic. The lawyer blamed the illegal deportation on Maj. Sergei Davidov, the chief of Nalchik airport check service, his assistant Capt. Alexei Nesvit, FSB Capt. Eldar Gayev, military procurator's deputy, LTC Konstantine Belchenko. "I am going to bring a suit against those named here who violated the law and harmed my client," the lawyer said. Last year, the local authorities and law enforcement agencies deported Bolat Hajji Bairam, for formal occasion. Later the Supreme Court canceled the decision of a lower court and ruled the deportation of the Turkish citizen was illegal and restored his rights. The appealer's residence permit was prolonged till 2008. The court's ruling made the return of Bolat H. Bairam to Kabardino-Balkaria legally possible. So, on August 23, the man arrived in Nalchik but was not allowed to enter the republic and detained at the airport. "I was just surprised to know that there was a confinement inside the airport building where my client was kept without any reason or legal ground," the lawyer said. The human rights representatives explained what they were doing on the issue in detail while Mr. Bairam was illegally under arrest. The lawyer's request to meet with his client was dismissed by the Prosecutor's Office, including military prosecutor's office. "That is the violation of human rights of my client," Mr. Kuchukov said. "According to the Constitution of Russian Federation, European Convention on human rights and other international standards each person has the right to have a qualified legal assistance. Nevertheless, they offered me to buy the ticket to Istanbul for my client and only then they will allow to meet him," the lawyer said.
