  Ramadan Tzey’s case (refugee from Kosovo deported from Adygeya) will be considered in the European court

 

As Aslan Panesh, the lawyer of the deported from Adygeya to Turkey in May this year repatriate from Kosovo Ramadan Tzey, informed “AdygeyaNatPress” agency, documents in the European court on human rights had been prepared and sent. They contain the request to consider an opportunity of influence on corresponding instances of Russia for that the decision on Tzey’s deportation could be cancelled. The basis for addressing to the European court, in opinion of the lawyer, serves that “above-stated decisions were made in infringement of the Convention “About protection of human rights and basic freedom”, as well as the internal legislation of Russia”. 

In particular, in R. Tzey’s complaint it is spoken: “with the decision of Maykop town court of September, 11 2003 concerned satisfaction of my claim (about prolongation of residence permit - ed.) I was rejected - ostensibly in connection with its groundlessness. That decision of the court was appealed against by me in the Supreme court of Adygeya. With cassation definition of the judicial board on civil cases of the Supreme court of Adygeya of 07.10.2003 that decision of Maykop town court was cancelled as illegal and was sent to the same court for new consideration. 

On December, 9 2003 Maykop town court, having referred to the same reasons which have been recognized by the board of the Supreme court as illegal, again made a decision about refusal in the claim satisfaction.

On 18.12.2003 I appealed against for another time that decision having addressed to the Supreme court of Adygeya. On 20.01.2004 the juridical broad on civil cases of the Supreme court of Adygeya had left Maykop town court’s decision without any change and my cassation – without satisfaction”.
